Monthly memberships renew every 30 days and require a 3-month minimum commitment.

Auto-renew cancellation requests must be made in writing to support@tuffgirlfitnessct.com at least 5 days before the end of your billing cycle.

All class pass/monthly plan purchases are final sale and we do not offer refunds for any class purchases.

Classes are non-transferrable or sharable.

This Membership Agreement (hereinafter referred to as “Agreement”) is entered into by and between Bodyology LLC, dba Tuff Girl Fitness and Altira Fitness (hereinafter referred to as “Bodyology”) and the Member (herein referred to as “Member”)
In this agreement, the terms “you” and “your” refer to the Member.

The Obvious Stuff

You understand that it is your responsibility to attend instruction sessions.

You understand that the entire course fee stated is due and payable according to the terms of this agreement whether or not you choose to attend instructional sessions provided by Bodyology.

The hours of operation and class schedule may be changed at the discretion of Bodyology.

Automatic Billing

Monthly plans are automatically billed each month on the same day to your credit card on file. Bodyology does not credit or refund for any charges that have already been processed. A charge of $25 will be made for any checks/payment returned due to non-payment.

Use Your Classes, Don’t Loose ‘Em

Monthly plan classes do not roll over and expire in 60 days. Bodyology does not offer refunds or credits for any unused classes.

Class Cancellation Policy

Bodyology has a four-hour class cancellation policy. You have up to 4 hours before class starts to remove your name from the class list and get that class back on your account. If you remove your name after this period, you will be charged for the class.

Personal Training and Assessment Appointment Cancellation Policy

Bodyology has a twelve-hour cancellation policy for personal training and personal assessment appointments. You have up to twelve hours before the start of your appointment to cancel. Cancellations must be made directly with the coach providing the service and must be made via phone or email. If you cancel within twelve hours of your scheduled appointment, a charge equal to 50% of the service cost will be applied to your payment information on file.

Switching Membership Plans

Three (3) Month Membership – You may make one (1) change to your 3-month membership agreement during the contracted period. Any additional changes will incur a $25.00 processing fee.

Sharing Is Caring, But This Membership Is Yours

It is expressly understood and agreed that this Agreement is not assignable or transferable by the Member and no rights or privileges granted by this Membership can be transferred or assigned by the Member.

No Hassel Freezes

You can freeze your contracted three (3) month membership for a duration of two (2) weeks to three (3) months at no cost or penalty if you need time off due to pregnancy, suffer a chronic illness or suffer a chronic injury. Chronic is defined as greater than 30 days. These freezes are always complimentary if you provide a note from your doctor detailing the medical necessity of the freeze. Your billing will be suspended for the duration of the freeze and will automatically resume once the freeze period has ended.

Any suspended payments will be added onto the Initial term of your agreement, extending the Membership term by the length of the freeze. Please allow five (5) business days for us to process the freeze.

Please Stay… But if You Must Go

All 3-month memberships are set to auto renew at the end of the contracted period to allow for continuous access to classes and services. If you do not wish for your 3-month membership to auto renew, please email support@tuffgirlfitnessct.com to assist in the cancellation. Bodyology requires five (5) business days to process the cancellation. Any remaining classes not used by the member will not be reimbursed.

Early Termination of a 3-month Membership

Early termination of a 3-month membership contract will incur a fee of $250.00, except for reasons listed below in the Buyer’s Right To Cancel. The termination will apply to future payments only.

No Fee Termination of a 3-month Membership

You may terminate your contract within three (3) business days after receiving a copy of the contract or agreeing to contract online.

You may terminate a 3-month membership, without any fees, if you become disabled during the contracted period or move your residence greater than 25 miles from Bodyology. The State of CT details the Client’s rights below:

Buyer’s Right to Cancel

If you wish to cancel this contract, you may cancel by emailing support@tuffgirlfitnessct.com or mailing a written notice by certified or registered mail to the address specified below. The notice must say that you do not wish to be bound by this contract and must be delivered or mailed before midnight of the third business day after you sign this contract. After you cancel, the health club may request the return of all contracts, membership cards and other documents of evidence of membership. The notice must be delivered or mailed to:

You may also cancel this contract if you relocate your residence further than twenty-five miles from any health club operated by the seller or from any other substantially similar health club which would accept the obligation of the seller.

This contract may also be cancelled if you die, or if the health club ceases operation at the location where you entered into this contract. If you become disabled, you shall have the option of (1) being relieved of liability for payment on that portion of the contract term for which you are disabled, or (2) extending the duration of the original contract at no cost to you for a period equal to the duration of the disability.

You must prove such disability by a doctor's certificate, which certificate shall be enclosed with the written notice of disability sent to the health club. The health club may require that you be examined by another physician agreeable to you and the health club at its expense. If you cancel, the health club may keep or collect an amount equal to the fair market value of the services or use of facilities you have already received.

Please Be Nice and Follow the Rules

You agree to abide by the rules and regulations governing the conduct and operation of instruction sessions, students, and observers, now and those prescribed in the future by Bodyology. You acknowledge that rules and regulations governing the gym may be changed from time to time, and agree to abide by all such rules and regulations as adopted or hereinafter amended. Bodyology reserves the right to revoke or terminate your membership in the event that you fail to abide by the rules and regulations, or for any other reason.

Watch Your Stuff

Bodyology, its agents, employees and landlords shall not be responsible for damaged,lost or stolen articles, whether inside or outside the Bodyology facility.

Smile. You’re On Camera.

You agree to authorize Bodyology, its successors and assigns, and those acting under its authority, to copy, use, publish for art, advertising, trade, or any other lawful purpose whatsoever, photographic portraits, pictures or video of you, in which you may be included in whole or in part.

Heavy weights and drugs don’t mix.

You agree that while you are using the Facility or participating in a training session to refrain from the use of and that you will not be under the influence of any medication that may impair your physical or mental capabilities, alcohol, or drugs.

You acknowledge and agree that such use or influence may increase the risk of serious bodily injury or death to yourself or others.

Please Don’t Open a Gym Next Door

In consideration of the training obtained, Member agrees, during the period of this agreement, and for a period of one (1) year following termination of his/her membership with Bodyology, not to engage in the instruction of professional exercise, fitness consultation and/or offer similar training or bootcamp instruction within a ten (10) mile radius of any facility operated by Bodyology.

The Death Waiver (Liability Waiver)

Member agrees and understands that the use of Bodyology, the equipment therein and the exercises and activities to be done by the Member involve a degree of risk including, but not limited to, injury, accident, death, loss, and cost or damage to my person or property. Member also agrees and understands the risk of transmission of infectious disease, whether related to the novel coronavirus SARS-CoV-2 or other pandemics, viruses, disease outbreaks, epidemics, public health emergencies and/or otherwise.

Member expressly agrees the Member assumes any and all risks related to the use of all of Bodyology’s facilities, Bodyology sponsored activities and/or any transportation provided by the Bodyology, even if the risk was created by the NEGLIGENCE of Bodyology, or an agent or employee thereof.

Accordingly, Member releases, indemnities, discharges, absolves and holds harmless Bodyology, building owners, employees, instructors, assigns officers, shareholders, partners, and successors, from any and all claims, suits demands, cause of action damages or liability arising out of or in any manner related to any activity engaged in by the Member at Bodyology or the use of any of its facilities, even if the risk was created by the NEGLIGENCE of Bodyology, or an agent or employee thereof. By signing this agreement, Member agrees that he or she will not sue the Bodyology for money damages for personal injury sustained by the Member even if due to the NEGLIGENCE of Bodyology. By signing this Agreement, Member understands that he or she is giving up substantial legal rights.

Enforcement

If any provision of this Agreement is held to be invalid or unenforceable by a court of competent jurisdiction, such holding shall not affect the validity or enforce ability of any other provision, which shall remain in full force and effect, and the provision held invalid or unenforceable shall be deemed modified so as to give the provision the maximum effect permitted by applicable law.

Governing Law

This agreement shall be governed by the laws of the State of Connecticut

This Agreement comprises the entire agreement pertaining to membership of any other relationship between the parties, and no other agreement of any kind will be recognized.
